The Garden Bar Bistro – Online Gift Card Terms & Conditions
(Valid for 3 years as required under Australian Consumer Law)
These Terms and Conditions apply to gift cards purchased online or in-venue for use at The Garden Bar Bistro, Coral Sea Marina, Airlie Beach, Queensland.
By purchasing, using or attempting to use a The Garden Bar Gift Card, you agree to these Terms and Conditions and all applicable Australian laws, including the Australian Consumer Law (ACL).
1. Definitions
- “Gift Card” means a prepaid digital voucher issued by The Garden Bar with a stored monetary value.
- “Purchaser” means the person who buys the Gift Card.
- “Cardholder” means the person who uses the Gift Card (may be different to the purchaser).
- “We”, “us”, “our” means The Garden Bar Bistro.
2. Purchase & Delivery
- Gift Cards are purchased through our WoWApps ordering platform, with payments processed securely via Stripe.
- Payment must be made in full at the time of purchase.
- All Gift Cards are digital. If purchased in venue, the digital card will still be issued by email.
- The Purchaser is responsible for supplying correct recipient details. We are not liable for Gift Cards sent to an incorrect email due to inaccurate information provided at checkout.
- We may decline or cancel an order if payment fails, fraud is suspected, or these Terms are breached. Refunds will be made where required by law.
3. Value, Currency & GST
- Gift Cards are issued in Australian Dollars (AUD).
- The value loaded onto the Gift Card is determined at the time of purchase.
- Goods and services purchased with a Gift Card include GST where applicable.
4. Expiry & Validity Period
- Gift Cards are valid for 3 years (36 months) from the date of purchase, in accordance with ACL requirements.
- WoWApps does not display the expiry date on the Gift Card; however, the expiry is calculated based on the “Date Sold” visible in our system.
- After expiry, any unused balance is forfeited unless otherwise required by law.
- No term or condition may reduce the mandatory three-year validity period.
5. Fees & Charges
- No post-purchase fees apply (including activation, account-keeping or balance-check fees).
- Standard online payment surcharges may apply at the time of purchase, but no fees apply after the Gift Card is issued.
6. Redemption & Use
- Gift Cards may be redeemed in-venue at The Garden Bar Bistro for food, beverages and eligible services.
- Online redemption is not currently enabled; however, this may be introduced in future.
- Gift Cards cannot be used for:
- Third-party venues or services
- Gambling or gaming products
- Cash withdrawals
- Gift Cards cannot be redeemed for cash, except where required under the ACL.
- If the bill exceeds the Gift Card balance, the difference must be paid using another accepted payment method.
- Any remaining balance stays on the Gift Card until fully redeemed or expired. Partial redemptions are allowed.
7. Balance & Enquiries
- Staff can check your Gift Card balance in venue upon request by looking up the card in our WoWApps system.
- Customers may contact us directly for balance information.
8. Lost, Stolen or Damaged Cards
- Treat your Gift Card like cash. Lost, stolen or damaged Gift Cards may not be replaced.
- If verifiable proof of purchase is provided (e.g., Stripe receipt or gift card email), we may, at our discretion, issue a replacement card for the remaining balance.
- We are not responsible for unauthorised use of a Gift Card.
9. Refunds, Exchanges & Consumer Guarantees
- Gift Cards are non-refundable and cannot be exchanged for cash, except where required by law.
- Goods or services purchased using a Gift Card are subject to consumer guarantees under the ACL.
- If a refund is owed for goods or services purchased with a Gift Card, we may reapply the refunded amount to the same Gift Card or issue a new one where lawful.
10. Restrictions
Gift Cards must not be:
- Used for unlawful purposes
- Resold or used for marketing, competitions or promotions without written approval
11. Technical Issues
- We are not responsible for inability to redeem a Gift Card due to technical issues with WoWApps, Stripe, internet services, or POS systems outside our control.
- If a valid Gift Card cannot be redeemed due to a technical problem, we will take reasonable steps to resolve the issue or provide an alternative redemption method.
12. Changes to Terms & Conditions
- We may update these Terms from time to time, subject to applicable laws.
- Changes will not reduce the expiry period or balance of an already-issued Gift Card.
13. Privacy
- Personal information collected during the purchase or redemption of a Gift Card is handled in accordance with our Privacy Policy and Australian privacy legislation.
14. Governing Law
- These Terms and Conditions are governed by the laws of Queensland, Australia.
- Any disputes are subject to the jurisdiction of Queensland courts.
